Learn More About The Residences at Seafire

Thank you for your interest in The Residences at Seafire, located in Grand Cayman, Cayman Islands. Please read the information provided within this rental contract.
Once the reservation is booked, and upon receipt of your signature and deposit, your reservation is confirmed.

We kindly request the number of adults and children who will be staying overnight at the property. Please note that infants accommodated in cribs are not included in the occupancy count. All units are fully licensed and regularly inspected. Exceeding the maximum legal occupancy may result in eviction without refund.

Check-in time is 4PM & check-out time is 11AM unless otherwise agreed.

Deposits: With your signature in the contract and non-refundable 25% deposit [Deposit #1] of the total rental contract paid, your reservation is confirmed and subject to the cancellation and revision policies below. 

Full payment of the balance due [Deposit #2] is required 90 days prior to the reservation arrival date.
 

Cancellation Policy: All cancellations must be made in writing. Cancellations made before 90 before the arrival date will result in forfeiture of deposit #1.  

Cancellations made after 90 days before arrival will result in forfeiture of deposit #1 and deposit #2.

No refunds for late arrivals or early departures in any season.   

We strongly advise the purchase of Travel Insurance to protect your vacation investment in the case of an unplanned reason for cancellation.
 

You may choose your own trip insurance company and we suggest either www.travelguard.com or www.csatravelprotection.com as reputable U.S. based companies that offer policies for purchase online.
 

DAMAGE POLICY: Normal “wear and tear” and small consumable items are understood to be the responsibility of the unit owner. Guest should report any damage to the property manager upon discovery so that it may be repaired ASAP. Should there be any damages or missing items identified upon your departure, we will provide you a property manager’s report including photos as applicable. The cost of any damage incurred during your stay at the property will be debited from the credit card on file. All properties are non-smoking; any smoking in a property or on the balcony will result in a USD$1000.00 charged debited from the credit card on file.

 

RENTAL POLICIES, LIABILITY WAIVER AND SAFETY WARNINGS:

  1. Any weddings or events involving invited guests must be approved in writing.
  2. Guest agrees to use the property for private purposes and cannot sublet, convey use to another party or use for business purposes. The Rental Program Manager has right to access the unit with at least 24-hour's notice.
  3. People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. Each villa has a licensed maximum. Exceeding the legal occupancy risks eviction with no refund.
  4. No pets are allowed in any of the properties without prior written approval.
  5. Smoking is NOT allowed inside the villa or on the balcony’s under any circumstances. However, for our guests who smoke, smoking is allowed outside in designated areas. Please do not allow your guests, who smoke, to litter the beach or landscaping with cigarette butts.
  6. No fishing equipment or scuba tanks inside the house please.
  7. Please conserve fresh water. All fresh water on the island is supplied by desalinization. Additionally, please put nothing inorganic in the toilet other than tissue paper.
  8. The Caribbean has ants/bugs looking for food, especially sugar/sweets. The units are all sprayed monthly, but guests are advised to keep food stored and counters wiped to prevent unwanted pests.
  9. Furnishings must be left in the position they are found. The maids cannot reassemble/replace the furniture after you have left. If furniture is left rearranged upon departure, movers will be hired at your expense and charged to the credit card on file.
  10. In the unlikely event that a contracted villa is either unavailable or uninhabitable for a guest's stay; SRM will make extraordinary efforts to obtain similar or better accommodations for the guests (subject to their approval). SRM maintains strong relationships with other on-island managers, owners, other villa-rental agents and the Cayman Islands Tourism Department. However, should acceptable accommodations not be found, the limit of financial liability for SRM will be a prompt, full refund of all monies paid OR an alternate stay at the subject property.

Neither owner nor agent shall be liable to you or any other person by reason of implied warranty, condition or other term, or under the terms of this contract; for any loss of profit, consequential loss, damage or other claims (whether caused by the negligence of the owners, their servants or agents or otherwise), which arise out of or in connection with the provision of the property or the use of the property by you or your invited guests. Further; neither owner nor agent will be held liable for damages arising from injury, accident or death involving the property, pool or the sea. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises. POOLS ARE INHERENTLY DANGEROUS. GUESTS ARE RESPONSIBLE FOR SUPERVISION OF CHILDREN AT ALL TIMES.
 

HURRICANE/STORM POLICY: Neither owner nor agent shall not be liable for events beyond his control which may interfere with the Guests(s) occupancy, including but not limited to, Acts of God, acts of governmental agencies, fire, strikes, war, and inclement weather, including flooding. No rebate or refund will be offered in these circumstances. Storms and bad weather are considered acts of God. Travelers are always at risk of experiencing bad weather while on vacation or holiday. While no refunds will be made for bad weather, refunds will be issued if:

  • The local authorities order mandatory evacuations due to a “Tropical Storm/Hurricane Warning” in the area where the villa is located. The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund any unused portion of the rental fee from guest currently staying at the property.

 

FURTHERMORE, GUEST AGREES TO: *

  • Ensure that no damage is done to the property or its contents, beyond normal wear and tear.
  • No contents are removed from the Property.
  • No smoking is undertaken inside the Residence. In the event the house suffers from cigarette or cigar odors, a US$1000 charge will be charged to the credit card on file to remediate the damage. No smoking on balconies.
  • Not use the air-conditioning system while windows or doors are open to the outside.
  • All garbage is placed in refuse containers and food is not to be left on balconies.
  • All doors and windows of the unit should be left closed & locked at check-out and when you are away from the unit.

Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental monies, and the guest will not be permitted to check- in. By acknowledging this document and/or sending a deposit to hold a chosen date, guest agrees to all terms and conditions of this agreement. Guest further states that he/she is at least twenty-four (24) years of age and will be the principle guest and, as such, will be completely responsible for the actions of other guests, if any, for whom he/she may be making these arrangements.

 

GOVERNING LAW:

This contract and any disputes arising from it will be governed by the law of the Cayman Islands.

The Seafire Residence Management rental program and The Residences at Seafire have no affiliation with InterContinental Hotels Group.

Guest agrees that he/she will present valid photo ID and physical credit card that was used to make the original reservation at the time of check-in. If a credit card was not used to pay for original booking, a major credit card will need to be provided and authorized to match the minimum daily Resort authorization at day of check-in.
